Elizabeth A. Schleuning OSB #85427 client, Damion Gilday denied injuring me in a letter to small claims court (he never appeared in small claims, I should have won by default), forcing me to expend much money and energy to re-file in circuit court.

Fact, she refused to answer most of the questions. (Is that justice or a double standard?)

Elizabeth A. Schleuning OSB #85427 did NOT fight her case in front of a jury that she/client ASKED for. Instead, Elizabeth A. Schleuning OSB #85427 chose to use rule 47 of ORCP.

Is that a cowardly act, or smart lawyering? Is she a great debater? You decide!

Did Elizabeth A. Schleuning OSB #85427 win a fair, moral fight? Not in my opinion, read about it throughout pages 1, 2 and 3 of www.suegilday.com.The case was dismissed because I did not have the money to fight the case.

In www.suegilday.com I answered extensively and did not receive a reply.

I'm told that Elizabeth A. Schleuning OSB #85427 brought charges against my lawyer Michael Genna with the bar. I was asked questions by the bar.

Elizabeth A. Schleuning OSB #85427 argued that I did not prove Res Ipsa Loquitur, I strongly disagree.

Elizabeth A. Schleuning OSB #85427 did not win on merit, but by default.

She got the judge to toss the case about a week or two before jury selection.

I was given a chance to refile, but that would be like pouring money down an endless hole.

Does she deserve to have a law license? Do these judges?

In my opinion, Lane County judges in Eugene, Oregon, routinely violate the US Constitution, violating the 1^st Amendment and several others, such as having my day in front of a jury and creating their "own" laws by legislating from the bench.

The State Congress has made no effort to address these issues since I made them aware of this case years ago.

My Opinion, What is happening to me can happen to you!

You and all of Oregon are at risk. Did you know that any doctor or dentist can seriously injure you and there is nothing you can do about it? The proof of this is Rule 47 of Oregon Rules of Civil Procedure, read it here: http://www.leg.state.or.us/ors/orcpors.htm. It says that the injured person must have a Lawyer hire another doctor to testify against the doctor that injured you, or you loose without ever going to court. (Regardless of the tons of evidence you may have and You cannot hire that witness yourself) This is in violation of federal equal protection laws & the Constitution.

Doctors & Dentists belong to societies that immunize one another by agreeing not to testify against each other. I am suing DAMION GILDAY DMD who it appears owns $3 Million in assets [year2004] at Village Plaza Loop, Smith St., River Pointe, Park Grove, 10th St., Willamette St., Arrowhead. He admitted to injuring me with a broken drill/file then he hides behind Rule 47. He wants the case dismissed without a trial that HE ASKED FOR. He would not face me in Small Claims for $5,000 for the loss of my tooth & much more. I'm on Disability. He's collected over $8,000 from my family & our insurance.
